Eon Exclusives Terms and
Conditions
Updated as of March 2024
These Terms and Conditions (“Terms”) shall govern the issuance, use,
cancellation and renewal of Eon Group of Companies (“EGC” or “We”) Eon
Exclusives. By using the Eon Exclusives, it shall be construed that the you
have read, understood, and agree, without limitation or qualification to be
bound by these Terms.
I. Qualification
To qualify as an Eon Exclusives member, you must be at least 18
years old, with approved application, and must have paid the Php 200 in requesting
and availing a physical card, which can be increased at any time without prior
notice.
II. Membership Application
- Applications
for Eon Exclusives membership may be done over-the-counter or through Eon
Exclusives website.
- For
over-the-counter applications, you have to complete the application form
in our outlets using the gadget available with the help of our associates.
Upon approval of the application, you will be immediately an Eon
Exclusives member.
For applications through Platforms, you are required to register
and create an account. You are responsible for safeguarding your username and
password, and for any activities or actions under said account. We are
authorized to assume that any person using the Platforms with your username and
password is either you yourself or is authorized to act in your behalf.
- You
are required to keep your personal data file complete and updated. We will
not be liable for any loss, damage, injury or claim arising from your
failure to keep your personal data file accurate, complete and updated.
- Eon
Exclusives has the absolute discretion to reject any application for
membership.
III. Membership Validity
- Eon
Exclusives membership is lifetime; however, you have an option to
deactivate your account.
- There
is no expiration to unused points but in order to maintain your Eon
Exclusive Prime membership, you must accumulate a total of 500 points from
January – December every year.
IV. Eon Exclusives Uses and Restrictions
- Eon
Exclusives can be used to earn and redeem points at any of its partner
merchants.
- Eon
Exclusives is not a bank or credit card.
- Eon
Exclusives is not transferable, and is valid for use only if presented
when processing any transaction.
- Eon
Exclusives may not be used, and Eon Exclusives points will not be earned,
for purchases or activities identified by Eon Exclusives as not eligible
for earning Eon Exclusives points.
- Eon
Exclusives cannot be used in conjunction with other rewards cards (i.e.
BDO Rewards, Ace Rewards, etc.)
- Eon
Exclusives is and shall remain the property of Eon Group of Companies.
- Eon
Exclusives is valid only in the Philippines.
V. Earning and Redemption of Eon
Exclusives Points
- Earning
and redemption of Eon Exclusives points may differ for each of EGC's
merchant. Click here (link of list of
partners/merchants) for a complete list of EGC’s merchants and learn how
to earn and redeem Eon Exclusives points from them.
- Members
with valid Eon Exclusives may use their Eon Exclusives points to redeem
goods or services at any of EGC’s partner merchants. Eon Exclusives points
cannot be exchanged for cash.
- Eon
Exclusives members should keep transaction receipts, which may be required
in case of request for points verification by the member.
- EGC
reserves the right to adjust on earned or accrued Eon Exclusives points as
it sees fit, including but not limited to, deduction of points arising
from disputed transactions, or those from returned goods or refunds.
- For
the redemption of Eon Exclusives points, the points reflected in EGC’s
records shall be deemed final and correct. EGC has the exclusive right to
determine the available number of points to be awarded to or available for
redemption by the member.
- Eon
Exclusives points redeemed may no longer be restored.
- Redeemed
awards or privileges are not exchangeable for other awards or privileges.
They are not refundable, nor can they be sold or transferred for cash or
credit, under any circumstance.
- EGC
or any of its partner merchants are not liable for the unavailability of
any award or privileges.
- Redeemed
awards and privileges are subject to the return and exchange policy of EGC’s
partner merchant.
- EGC
shall not be liable for fraud, misuse, or other misconduct involving the
earning and redemption or use of Eon Exclusives points, which may result
in the immediate cancellation or termination of the relevant Eon
Exclusives and the forfeiture of the points and other awards and
privileges in connection thereto.
- Employees
of EGC and its partner merchants are subject to their respective
employer’s policy on the earning and redemption of Eon Exclusives points.
- Other
guidelines, promotions and offerings for earning and using Eon Exclusives
points are provided in the Platforms and collaterals posted by EGC, which
may be updated anytime, without need of prior notice.
VI. Lost, Damaged or Stolen Eon Exclusives Card
1. EGC will not be liable for the
lost/damaged/stolen Eon Exclusives Card and the Eon Exclusives member must be
responsible to it.
- If
the member wish to avail another card, he or she must request again. The
fee is still Php 200.
VII. Cancellation
of Eon Exclusives
Eon Exclusives will be
automatically cancelled, and all awards and privileges in relation thereto will
be forfeited, in case of death or legal incapacity of the Eon Exclusives member
and violation of the Terms and other guidelines as may be issued by EGC from
time to time in relation to Eon Exclusives.
VIII.
Intellectual Property
All information,
material and content available on the Eon Exclusives and in the Platform,
existing and future, including but not limited to, trademarks, logos, service
marks, features, functions, text, graphics, logos, button icons, images, audio
clips, data compilations and software, and the compilation and organization thereof
(collectively, the “Content”) are owned by EGC, subsidiaries or affiliates, and
are protected by international laws, including laws governing copyrights and
trademarks.
Except as required
under applicable law, neither the Content nor any portion of the Eon Exclusives
or of the Platform may be used, reproduced, republished, uploaded, posted,
transmitted, distributed, duplicated, disseminated, copied, sold, resold,
accessed, decompiled, disassembled, reverse engineered or modified, or
otherwise exploited, in whole or in part, for any purpose without EGC’s
express, prior written consent. Nothing contained herein grants or should be
construed as granting, by implication, estoppel, or otherwise, any license or
right to use any trademarks, trade names, service marks or logos displayed on
the Eon Exclusives or in the Platform, without EGC’s written permission or such
third-party owner, as may be applicable.
IX. Limitation
of Liability
EGC disclaims all
liability, whether based in contract, tort (including negligence), strict
liability, or otherwise. EGC shall not be liable for any claim, suit or
proceeding of whatever nature or any ordinary, direct, indirect, consequential,
incidental, special, punitive or exemplary damages or any other losses or
liabilities which may arise out of, or in connection with, or result from the
use of the Eon Exclusives, including but not limited to: a) Exclusives not
being honored or being declined; b ) any delay or interruption in the crediting
of points for any reason; c) fraudulent or unauthorized use of Eon Exclusives;
d) unauthorized disclosure or breach of security or confidentiality of card
information with or without Member’s participation; e) business interruption;
f) transmission blackout, data non-delivery, misdelivery, corruption,
destruction or other modification; g) computer viruses, system failures,
malfunctions or any breach in connection with use of Eon Exclusives or of the
Platform; h) any delays, inaccuracies, errors in or omissions in the content of
Eon Exclusives or of the Platform.
X. Indemnity
Eon Exclusives Member
agrees to indemnify and hold EGC, its affiliates, directors, officers,
shareholders and agents, free and harmless from and against any claims, demand,
loss, suits or proceedings, damages, costs and expenses including attorneys’
fees arising from or related to the use of the Eon Exclusives.
XI. Force Majeure
EGC shall not be liable
for any breach of the Terms when hindered or prevented from carrying out its
obligations by any cause outside our reasonable control, including by
lightning, fire, flood, epidemic/pandemic, extremely sever weather, strike,
lock-out, labor dispute, act of God, war, riot, civil commotion, malicious
damage, failure of any telecommunications or computer system, prolonged power
outages, breakdown in computers and communication facilities, computer-related
errors, typhoons floods, public disturbances and calamities or other similar
cases compliance with any law or mandate from the government, accident or by
any damage caused by of such events.
XII. Governing Law
These Terms shall be
governed by and construed in accordance with the laws of the Republic of the
Philippines.
XIII. Transfer/Assignment
EGC shall have the
right to assign or transfer in whole or in part any of its rights and
obligations arising from the Eon Exclusives, without need of prior notice to or
consent of the Eon Exclusives members.
XIV. Revisions to the Terms
and Conditions
EGC reserves the right,
at all times, without notice, and its sole discretion:
- To
make any changes whatsoever to these Terms, including any guidelines in
relation to the Eon Exclusives;
- To
withdraw, cancel, withhold, substitute, deny access to or use of, or in
any way change any of the awards or privileges previously advertised or offered;
and
- To
terminate or materially alter the Eon Exclusives program which may result
in the revocation of the membership of a member and/or the right of a
member to use Eon Exclusives or to utilize any awards or privileges.
Any question or dispute relating to Eon Exclusives will be subject to the final decision of EGC.
All users
and members of Eon Exclusives Loyalty Program are expected to
read carefully the Terms and Conditions and Privacy Policy for Eon Exclusives
Loyalty Program.
Who We Are
Eon Group of Companies (EGC, “we”, “us”, or “our”) operates and manages Eon Exclusives
which aims to incentivize the purchasing behavior of its members. Eon
Exclusives is the loyalty program where Eon Exclusive members can earn and
redeem points every time they avail products and services. Eon Exclusives member
who meets the criteria and spending level in a year may be upgraded to Eon
Exclusives Prime, an elite version of Eon Exclusives will receive an exclusive
access to perks and privileges from EGC and its affiliates.
Our Commitment
We value
and respect the Eon Exclusives members’ privacy rights under the Data Privacy
Act of 2012 (DPA) and other applicable privacy laws. The objective of this
Privacy Policy (or “policy”) is to inform Eon Exclusives members how we
collect, use, share, retain, and dispose their personal data in relation to
their membership with the Eon Exclusives Loyalty Program and its related
services. This policy also outlines our practices and the security measures we
have in place to ensure that our members’ personal data are protected and
processed in accordance with the purposes disclosed in this policy and the law.
What We Collect
EGC may
request the Eon Exclusives member to provide his or her personal data,
depending on the services which the member is using. The personal data we may
collect from you are as follows:

Exclusives account number
The Eon Exclusives member is responsible in ensuring that the personal
data he provides is accurate and updated. Any member may update his or her
personal data at any time by accessing the member’s Eon Exclusives account on
the Eon Exclusive website. EGC and its affiliates, specialty stores, service
group, or partner merchant shall not be held liable for any loss, damage,
injury or claim arising from the member’s failure to keep his account
information or personal data updated.
How We Use Your Personal Data
The personal data collected
shall be used or processed pursuant to any or all of the following purposes:
- For administration of the Eon Exclusives
loyalty program, including registration, maintenance of the Eon Exclusives
account, points earning or redemption, and such services related to the Eon
Exclusives Loyalty Program;
- To verify your identity when you access
your account;
- For data analytics and direct marketing; for
market research and analysis – to better understand your interests and
preferences; to send you marketing promotions, offers, or latest news on Eon
Exclusives, co-branded offers, and affiliate and partner offers, which may
be sent through email, phone, and SMS and other electronic means of
communication
- To administer any raffle draws or
competitions;
- To render such services which may be
requested by the member such as but not limited to addressing inquiries
and complaints, updating or deletion of records;
- To develop and test any changes or
improvements to our website or services;
- To send you service emails or
communications or update you about any changes to our policies or services
or any information required by law to be disseminated;
- To provide necessary services related to
your Eon Exclusives membership;
- To serve EGC’s legitimate business
purposes.
In certain
circumstances, EGC may need to share, provide or disclose the member’s
information to enable us to comply with legal or regulatory requirements, such
as criminal, civil or administrative investigations, among others.
Member’s Consent
By
accessing our website, or creating an Eon Exclusives account, and availing of
privileges, the member confirms that he or she has read, understood and agree
to be bound by this policy and consents to the collection, use, sharing or
otherwise processing of the member’s personal data by EGC and its service
group, affiliates, specialty stores, and partner merchants obtained at the time
of submission of application for membership, whether manually or
electronically, and/or upon joining Eon Exclusives membership. EGC shall
continue processing the member’s personal data as long as the member maintains
his membership or continues to use Eon Exclusives.
By using Eon
Exclusives and/or participating in the Eon Exclusives Loyalty Program, the
member reaffirms his consent to the processing of his personal data. Below is a
copy of the member’s consent:
“By accessing the Eon Exclusives website, or availing of Eon Exclusives privileges, you signify that you have read,
understood and agree to be bound by the Terms and Conditions and Privacy Policy
of Eon Group of Companies (EGC) for Eon Exclusives.
Subject to applicable laws and regulations on data privacy and
protection, you hereby give your full and absolute consent to EGC and its
affiliates, specialty stores, partner merchants, and service group to collect,
use, store, share or otherwise process your personal data in accordance with
the purposes disclosed in the Eon Exclusives Privacy Policy, such as but not
limited to, account management, direct marketing, data analytics, announcements
on system enhancements, updates, discounts, sales and marketing promotions
and/or for the performance of such other services which you may request from EGC.
In case you are chosen as a winner in any Eon Exclusives contests, promotional
campaigns or automated electronic draws, you hereby give your consent to EGC to
publish your full name in social media or in such media which may be necessary
to comply with requirements of regulatory agencies.”
The member
can withdraw or modify the scope of consent anytime by contacting our data
protection officer in the contact details below or through the opt-out
procedures in our emails or your Eon Exclusives account. Please note that
should you opt to withdraw or limit the scope of consent provided, we may not
be able to provide certain services and the member is unlikely to receive our
optimal overall member experience. If you opt out of receiving promotional
communications from us, we may still send you non-promotional communications
such as emails about your accounts or our ongoing business relations.
Data Sharing
- Our service providers and contractors
In order to
deliver certain services to you, we may need to share your personal data with
our service group consisting of the following:
- Our
officers, employees, personnel, and consultants;
- Our
parent and/or affiliate companies which may render support services to us
in line with the administration of the loyalty program;
- Our
authorized service providers, such as but not limited to: IT providers,
data encoders, website and database hosts, couriers and delivery,
advertising and marketing service providers, card printers.
Our service
providers have confirmed that they apply appropriate data protection policies
and security controls to keep your personal data safe and secured. We have also
imposed contractual obligations on these service providers to ensure that they
will only use your personal data to render the services agreed upon in relation
to your Eon Exclusives membership. We only share such information that is
needed to provide services to you and if we stop using a third party, we
require them to return, destroy or remove your information from their systems.
We do not, and will not, sell your personal data.
- Disclosure to third parties
Eon Exclusives will not disclose
your personal data outside EGC and its service group, except to third parties
as set out below:
- EGC specialty stores and/or selected
merchant partners where you have used your Eon Exclusives card and for
purposes of:
- offering promotions and
privileges;
- awarding and/or allowing
redemption of Eon Exclusives points in their stores;
- Any business or company which acquires
all or part of the Eon Exclusives business;
- Governmental bodies, regulators, law
enforcement agencies, courts or tribunals, or insurers when we are
required to do so, e.g., to comply with a legal obligation, to exercise a
legal right, to prevent or aid an investigation of a crime or to prosecute
offenders and/or to protect our employees or members.
Where We Process and Store Data
EGC stores,
processes and transmits personal data within the Philippines. EGC shall comply
with the applicable laws and regulations should it become necessary to process
or store your data in another jurisdiction.
Information Security
EGC ensures
the security and protection of your personal data against risk of data loss,
unauthorized access and disclosure, alteration and unlawful processing. Aside
from establishing policies, rules and procedures, the company also ensures that
all information is secured and protected within the scope of the organization. EGC
conducts periodic Privacy Impact Assessments to evaluate and manage the privacy
implications of projects, programs and processes. EGC also ensures that a
Personal Data Breach Management is in place.
EGC uses various appropriate
measures to safeguard your personal information. This includes but not limited
to:
Organizational measures: appointment of Data Protection Officer, access
control policy, security awareness training, among others.
Physical measures: security on data centers, card storage, biometric
devices, among others.
Technical security measures: encryption, anti-virus software, among others.
How Long We Will Store Your
Information
EGC will store your information
for as long as the member retains his or her membership to the Eon Exclusives Loyalty
Program or, for as long as needed for us to be able to provide the relevant
services to the member.
In some circumstances, such as
to meet our legal or regulatory obligations, resolve disputes, prevent fraud
and abuse, or enforce the Eon Exclusives Terms and Conditions, we may retain
your personal data beyond the 2-year period.
Disposal of Your Personal Data
Electronic files shall be
erased, while physical records shall be shredded for disposal. When
appropriate, anonymization techniques may be performed to permanently remove
identifiable information from our records. In all cases, we will make sure that
the personal information is destroyed in a way that prevents unauthorized
people from accessing, processing, or retrieving it.
Collection of Computer Data
We or our authorized service
providers may use cookies, web beacons, and other similar technologies for
storing information to provide you with a better, faster, safer and
personalized experience when you use the Eon Exclusives services and/or access
our digital platforms and technologies.
Cookies contain information
about the web activities of the user. This allows EGC to understand more about
your visit and help us to enhance your experience and may be used for
authentication and storing website information or preferences. You are free to
accept or decline cookies by modifying your browser setting to decline cookies.
However, should you choose to decline cookies, you may not be able to fully
experience the features of our website.
Web beacons are small graphic
images that may be included in the services available on our website and app
digital. These will allow EGC to count users who have viewed these pages, the
time spent on the pages, items searched for, among others, to better understand
your preference and interests so we can improve our services.
If you do not want to accept
cookies from the Eon Exclusives website, you can remove or reject cookies in
your browser settings. If you choose to do this, please be aware that Eon
Exclusives website may no longer function as intended.
The Rights of the Data Subject
As provided under the DPA, you
have the following data privacy rights:
Right to be informed. You have the right to be informed of the
collection and processing of your personal data, the purpose for which they
will be processed, among others. Thus, you are required to read this privacy
notice before giving your consent to the collection and processing of your
personal data.
Right to object. You have the right to object to the
processing of your personal data. You will be given an option or opportunity to
withhold your consent to the processing of your personal data whenever EGC
communicates with you.
Right to access your information. It is your right to obtain confirmation on
whether or not data relating to you are being processed as well as other
relevant information about the processing involved.
Right to updating or
rectification. You have the right to rectify
or correct any inaccuracy or error in your personal data through the Eon
Exclusives website.
Right to erasure or blocking. You have the right to the erasure or blocking of
your personal data in accordance with the requirements of the DPA, subject to
restrictions imposed by other regulations.
Right to damages. You have the right to be indemnified if you
incur damages due to inaccurate, incomplete, outdated, false, unlawfully obtained
or unauthorized use of your personal data.
Right to data portability. You have the right to obtain a copy of your data
in an electronic or structured format if the same is processed by electronic
means and in a structured and commonly used format by submitting a proper
request.
Right to file a complaint. If you have reason to believe that your
personal information has been misused, maliciously disclosed, or improperly
disposed of or that your data privacy rights have been violated, you have the
right to file a complaint.
If you intend to exercise any of
your abovementioned data privacy rights you, may contact our Data Protection
Officer (DPO). We may ask some information in order to verify your identity to
avoid unwanted disclosure of personal information.
Minors
Our website is intended only for
persons who are at least eighteen (18) years old. We neither offer products or
services nor knowingly collect personal data of persons below eighteen (18)
years old (“Minors”) without any legal basis or consent of the minor’s parent
or guardian. Should we learn that we were provided with personal data of
Minors, we will delete the same from our database.

request or inquiry should be made in writing, clearly state the material facts,
specify your contact information and include supporting evidence, if
applicable. EGC reserves the right to require further documentation from you,
depending on the nature of your request/inquiry.

Changes to Our Privacy Policy
This policy is subject to
periodic review. We may update this policy as we may deem fit or as may be
necessary to comply with government regulation. We may also revise this policy
to comply with the industry’s best practices or if there is a need to revamp
the website to adapt to new requirements of technologies or security protocols.
